Following a screening of “Chapter 8. Law School” from the 9-part docuseries “In the Absence”, attendees will hear from a panel of attorneys associated with the University of Memphis School of Law’s Neighborhood Preservation Clinic (Steve Barlow, Danny Schaffzin, Brittany Williams, Brigid Welsh), who will discuss the various legal issues and ethical considerations that arise in representing the City of Memphis, alongside a team of law students, in hundreds of cases filed pursuant to the Tennessee Neighborhood Preservation Act (T.C.A. 13-6-106) against vacant, abandoned, and derelict properties.  Among other topics, the program will consider the steps to filing and representing clients in lawsuits brought pursuant to the Neighborhood Preservation Act, working with and supervising student attorneys, the ethical implications of litigating in cases involving pro se litigants/property owners, representation of municipal and organizational clients, the nuances of in rem jurisdiction, balancing the City’s interest in addressing public nuisance properties with individual property rights, the complex and controversial history of efforts to address blighted properties, and various complex property title issues that affect NPA litigation.
